Governor Hatao Karnataka Bachao

Dear Friends,

As you are aware, the Governor of Karnataka Sri Hans Raj Bharadwaj has been continuously troubling the Government of Karnataka since the day he stepped into our soil. He has been constantly harassing the Ministers, troubling them on every small matter and needlessly creating issues to halt the smooth administration and functioning of the Government machinery. His recent action of sanctioning the prosecution of the Hon'ble Chief Minister of Karnataka without any concrete evidence and proof has been the last nail in the coffin beyond which his actions have become intolerable to the citizens of the state. Keeping this in mind, BJP has lodged a strong protest with the Hon'ble President of India to recall the Governor immediately so that peace and development can continue in the state.

BJP holds demonstration in Bangalore; demands governor's recall

The ruling BJP in Karnataka held a demonstration here today demanding recall of governor HR Bhardwaj for sanctioning prosecution of chief minister BS Yeddyurappa and accused the opposition Congress and JDS of indulging in "backdoor politics".

Addressing the protesting BJP members here, senior leader HN Ananth Kumar said the party would request President Pratibha Patil to recall the Governor.

In Karnataka, the Congress and the JDS lost the assembly polls in 2008, Lok Sabha elections in 2009 and zilla and taluk pachayat polls last year, he noted.

"They (Congress and JDS) don't have people's mandate. They are indulging in back-door politics", Ananth Kumar said.

Accusing the governor of hatching a "conspiracy", he asserted that the Yeddyurappa government would complete its five-year term.

BJP members raised slogans such as "get out, get out governor" and "Raj Bhavan: Extension of 10, Janpath".

Yeddyurappa hasn't done anything illegal: Nitin Gadkar

Accusing Karnataka governor HR Bhardwaj of foisting cases against BS Yeddyurappa, BJP chief Nitin Gadkari has said the state chief minister has not committed any "illegal act" in allotment of plots even though denotifying land in favour of his son was "immoral" and "not proper."

Commenting on Bhardwaj's decision to sanction prosecution against Yeddyurappa, Gadkari, who is in China on a five-day visit, told the Indian media here that denotification of land is the privilege of the chief minister, which was exercised by many of Yeddyurappa's predecessors.

"Denotification of land is privilege and right of chief minister given by law. Nothing is wrong with it. Before Yeddyurappa, (former chief ministers HD) Kumarasamy, Dharma Singh and SM Krishna exercised it several times. The governor has not taken action against them because they belonged to Congress Party," he said.

"Only thing is that BJP and I personally feel that denotifying land for his (chief minister's) son, though it is a legal decision, on the ground of morality, I think it is not good. It is not proper and immoral I think...," he said.

If it is illegal why the government has not taken action against the previous chief ministers? he asked.

Gadkari alleged that the governor's decision was politically motivated and that he was working under the directives of Congress.

The BJP demands his recall as he has already crossed the limits, he said.

It is total discrimination, Gadkari said, claiming that many number of cases filed against Yeddyurappa are politically motivated.

"They are misusing the institution of Governor and creating problems for democracy in the country. It is unfortunate that the institution of Governor is diluted in such a way that people have lost faith," he said.

Karnataka plunged into fresh political crisis as governor HR Bhardwaj, on Friday evening, accorded permission for prosecuting chief minister BS Yeddyurappa for his alleged involvement in land scams.

The governor's move, unprecedented in the state's history, prompted the BJP to reiterate its support for Yeddyurappa, besides calling for a Karnataka Bandh on Saturday.

The brief communiqué issued in this regard from Raj Bhavan said, “The petition given by two advocates of BangaloreSirajin Basha andKN Balaraj on 28.12.2010, requesting for sanction of His Excellency, the governor of Karnataka under section 19(1) of the Prevention of Corruption Act, 1988 and section 197 of the Criminal Procedure Code, 1973 for prosecuting the chief minister BS Yeddyurappa in an appropriate Court of Law for various grave allegations of corruption and criminal misconduct, has been considered by His Excellency the governor of Karnataka and he has granted the sanction to prosecute the chief minister.”

The governor’s nod now allows the two advocates to file a criminal case against the chief minister. Welcoming the governor’s decision, the two expressed confidence that they would emerge victorious in this legal battle.

The BJP, on its part, termed the decision 'as murder of democracy' and appealed to the people to voluntarily observe Karnataka Bandh on Saturday. Dharmendra Pradhan, BJP national leader in-charge of party affairs in the state, immediately held a meeting with the chief minister and senior party leaders of the state to formulate future strategies. “There is no question of Yeddyurappa stepping down,” declared Pradhan. “We will challenge the governor’s decision legally and politically,” he declared.

Leader of the Opposition in Lok Sabha, Arun Jaitley termed the governor’s decision as politically motivated. “The fact that the governor accorded permission for CM’s prosecution while the state high court was hearing a petition to decide as to who should probe the scams—Lokayukta or Justice Padmaraj Commission---shows that his action was politically motivated,” he said.

PM MISLEADING NATION ON SWISS BANK ACCOUNTS : SHANTA KUMAR

Shri Shanta Kumar, National Vice President of BJP and MP (Rajya Sabha) has said that Prime Minister Manmohan Singh and his Cabinet colleagues were misleading the country on the issue of black money stashed away in secret bank accounts in Switzerland and other tax heaven countries. He said that Indian Government is avoiding the issue of recovery of black money from Swiss Banks under some political pressure which is unfortunate and disgusting. He said fact is that Swiss Government wants to return the illicit money to concerned country and this has been conveyed to Indian Government also by the Swiss counterpart well in time but Indian counterpart is deliberately avoiding the issue by not fulfilling the necessary conditions and completing codal formalities to acquire back this money.

In a press statement issued here today Shanta Kumar said that he had an opportunity to participate in UN General Assembly as a member of Indian Parliamentary delegation in the October Month of 2010. Where the issue of corruption and flow of illicit money in various countries was also discussed. He said in the deliberations , Swiss representatives Mr Mithias Bachman disclosed that Swiss Government was committed to return their black money to the originating countries as Swiss Government consider this amount as “stolen property”. Swiss representatives also disclosed that besides enacting a law to return the black money to originating countries Switzerland has signed and ratified the UN Convention against corruption also. Swiss representatives also clarified that return of illicit money depends upon the political will of the concerned country. Swiss representative also disclosed that his Government has started to return back the illicit amount to the originating countries.

Shri Shanta Kumar said that Indian Government was not taking initiative to return back this black money to the country. He said that the whole world was concerned with the malice of corruption and after long discussions for two years UN passed a historical convention against the corruption in the year 2003 . He said the fundamental objective of the convention under Article 51 and 52 is to identify and return back the stashed away money to the originating countries. He said Indian Government has signed this convention on the last date of signing convention i.e. 9th December, 2005. He said more than five years have passed and Indian Government had not been able yet to ratified this convention and according to the provisions of this convention no member country can cooperate on the matter of illicit money flow without ratifying the convention.

Shanta Kumar said that UN convention against corruption is an important international legal tool to recover money from foreign banks. He said since the Indian Government had not ratified the convention so the Indian Government cannot initiate any action according to the convention.

BJP Vice President said that Prime Minister Mr Manmohan Singh in his statement has categorized this black money as the issue of tax evasion, in fact it was not the issue of tax evasion whereas it consists of property earned through unfair , illegal means which includes corruption also. He said it constitutes criminal offence and should be treated as against the law of the land meant for crimes. He said in the case of Hassan Ali Khan, Pune Stud Farm Owner, after the raid of Income Tax in his Bombay and Pune hidings IT department got information about Rs. One lac crore accounts deposited in Swiss Bank. He said that he was given IT notice for depositing rupees forty thousand crores as IT recovery. He said nobody dare to inquire from where Khan has deposited this black money in Swiss account. He said that this matter was raised in Maharashtra Vidhan Sabha also and was put under the carpet when this came to light that political big-bigs are hands to glow with Mr Khan. Unfortunately Indian Government un succeeded in getting Swiss Bank accounts information of Hassan Ali Khan.

Shanta Kumar said rupees seventy lack crores were deposited in Swiss Banks. He said according to report of Global Financial Integrity, rupees two thousand lac crores have been flown from India since 1947. He said this is the worst every biggest loot committed by the Pseudo Elites of our country.

Shanta Kumar urge the Central Government to deal with the issue of recovery of black money in Swiss banks on priority basis so that accounts holders in tax- heaven could not withdraw their amounts from these banks.

Press statement issued by, Shri M. Venkaiah Naidu, MP and Former BJP President regarding the need to immediately recall the Governor of KARNATAKA

The Bharatiya Janata Party demands immediate recall of the Governor of Karnataka, Shri H.R. Bhardwaj. He has embroiled himself in several controversies with the State Government and converted Raj Bhawan into Congress office and became a willing partner in the destabilization moves by the Congress and JD(S).

After having allowed the use of Governor’s office for political purposes he embarked upon a political confrontation with other constitutional authorities of the State. He wrote to the Speaker not to invoke his powers under 10th schedule and disqualify any defector. When that has failed, he recommended imposition of President’s Rule which was perverse and motivated particularly in the backdrop of the fact that the Chief Minister enjoyed a clear majority. Within 24 hours of recommending President’s Rule he did a volte face and asked the Chief Minister to seek fresh vote of confidence.

From time to time, the Governor has been making a running commentary on BJP and also on the Ministers in the State Government. He himself levelled corruption charges on the Government forgetting that he is holding a constitutional office and that decorum and restraint are required in a constitutional authority. The history sheet of extra-constitutionalism indulged in by the Governor disentitles him to occupy a worthy constitutional office. Now, he wants to permit prosecution of the Chief Minister and other Ministers. When the State Cabinet met and passed a resolution requesting the Governor not to permit prosecution, he unabashedly says that the Cabinet requesting him not to permit prosecution is like a thief complaining to the police. By this he has lowered the dignity of the Chief Minister and the entire Cabinet and by that the people of Karnataka. Who is the thief? Who allowed Quattrochi to sneak out of the country? Who allowed withdrawal of the money from frozen accounts? All this is in everybody’s knowledge. This shows the prejudiced mind of the Governor.

The BJP not only protests against the conduct of the Governor but also demands his immediate recall. The Centre by not recalling him has become a willing partner in this destabilizing and defaming move. The dirty tricks by the Governor and the Congress party will backfire on them if they do not act now and recall the Governor. The Governor is supposed to be the custodian of the Constitution and guardian of the State but he is acting contrary to that. Extra-constitutionalism is always his firm belief and using all extra-constitutional measures to demonstrate loyalty is always his political strategy. Shri Bhardwaj has utterly failed to detach himself from his political past and proved himself unworthy of occupying a high Constitutional office.

The BJP MPs will meet Hon’ble President on 24th January, 2011 to apprise the President about the atrocities committed by the Governor. Thereafter, all the BJP MLAs, MLCs and MPs will organize a protest dharna on 25th January, 2011 in front of Raj Bhawan. The BJP will also take up this issue in a big way in the ensuing session Budget session of Parliament.

BJP scoffs at Gandhi''s five-point agenda to tackle corruption

New Delhi, Jan 7 (PTI) The BJP today scoffed at the Government''s plan to let a GoM deal with the issue of corruption in the framework of five-point agenda outlined by Congress President Sonia Gandhi and said if the ruling coalition was serious it should set up a JPC.

"If the Congress'' conscience has awoken to tackle corruption, then it should set up a JPC on the 2G spectrum issue, let CBI function independently and remove the tainted Central Vigilance Commissioner," BJP spokesperson Shahnawaz Hussain said here.

He said Congress President Sonia Gandhi outlining the agenda to tackle corruption will not suffice and the UPA has to take more convincing steps to get rid of the scourge.

The Group of Ministers, which is expected to be headed by Finance Minister Pranab Mukherjee, is likely to include Home Minister P Chidambaram, Defence Minister A K Antony, HRD Minister Kapil Sibal and Law Minister Veerappa Moily.

The GoM will devise a roadmap for implementing the action plan outlined by Gandhi at the AICC Plenary here last month to battle corruption.

"Let them fulfil the promise they made of retrieving money stashed away in Swiss banks within 100 days of coming to power for the second term", the BJP leader said.

He also saw corruption as the main reason behind inflation and said onions from Pakistan that were stuck in docks should be released for public consumption.
